On January 20, 2026, at approximately 1722 hours, law enforcement responded to a traffic accident in Brooklyn Center, Hennepin County, Minnesota, where it was reported that a vehicle struck a person in a motorized scooter. Upon arrival law enforcement observed D. S. Lying on the ground with a motorized scooter and numerous parts from it in the roadway. Duc Huu Ly Le [DOB REDACTED], Defendant herein, was standing next to D. S. The Defendant admitted to driving the vehicle that struck D. S. Law enforcement noticed the odor of alcoholic beverage coming from the Defendant while talking to him.
Law enforcement also observed the Defendant had slurred speech, bloodshot watery eyes and had difficulty communicating. The Defendant denied consuming any alcohol. The Defendant agreed to perform standardized field sobriety tests. During the Horizontal Gaze Nystagmus test, the Defendant exhibited 5 out 6 clues of impairment. During the one legged stand test the Defendant showed multiple signs of impairment. The Defendant began the test during the instructional phase, the Defendant counted improperly, the Defendant began counting with the number 4 instead of the number 1 and the Defendant kept placing his foot down for balance.
Next, the Defendant performed the walk and turn test. During this test the Defendant showed several signs of impairment. The Defendant started the test during the instructional phase, the Defendant lost his balance several times, the Defendant did not properly align his feet heel to toe during the test, the Defendant swayed during the test, and the Defendant stepped off of the line and stopped counting steps. The Defendant agreed to provide a preliminary breath test (PBT) sample. The reading of the PBT was.133. The Defendant also admitted to taking Buproprion, Lexapro and Citalopram.
Law enforcement through their training and experience noted those are medications that can cause drowsiness, blurred vision and impairment when it comes to operating machinery. The Defendant was placed under arrest and was transported to the Hennepin County Medical Center. A search warrant was obtained for a sample of the Defendant’s blood. At 1956 hours a nurse completed the blood draw, and the blood draw kit was packaged by the nurse. Results of the blood draw are pending. Law enforcement was notified by staff at North Memorial Hospital that D. S. Suffered a broken left femur and a broken right ankle.
Law enforcement talked to D. S., and he stated he was hit by a vehicle head on. D. S. Said the driver of the vehicle did not slow down and it looked like he was not going to stop. D. S. Said before he was hit, other vehicles saw him and would move over on the road. The Defendant is in custody.
