On May 28, 2026, the court ordered a Rule 20 evaluation in Ramsey County District Court file 62-CR-22- 4354. JOHN ANDREW GUTZMAN [DOB REDACTED] received a stay of adjudication on a felony criminal sexual conduct in the fifth degree charge in that case. Gutzman masturbated in the presence of children at another family’s quinceanera celebration. The Rule 20 evaluation was to be done out of custody. At around 8:30 PM on May 31, 2026, officers were sent to Cherokee Regional Park at [ADDRESS REDACTED], St. Paul, Ramsey County on a man who was masturbating in public.
Officer spoke to the 911 caller who said they were having a family BBQ at the pavilion. There were 6 children present under the age of 12. They saw Gutzman at the tailgate of his pickup truck with his pants or shorts around his ankles. The group saw Gutzman’s penis while he masturbated for around 5 minutes. Gutzman faced the group and was not concealed by his truck. Gutzman entered his truck. The family heard loud noise coming from the truck’s speakers as if Gutzman were viewing pornography. The family said the children also witnessed Gutzman’s behavior.
One person at the BBQ said Gutzman dropped his pants all the way down and started jacking off. When asked if they saw Gutzman’s penis, the witness replied, “Yeah, we all seen it!” Gutzman committed this offense while charged with gross misdemeanor indecent exposure for displaying his penis and testicles to a woman at a gym facility in Dakota County District Court file 19WS-CR-8745. Officers made contact with Gutzman who claimed he was at the park listening to music and hoping friends would stop by.
Gutzman said he had to step out of his truck to urinate. He said someone walked by when he was urinating, and he pulled his pants up. When the person walked away he finished urinating. Officers arrested Guzman. Guzman was advised of his constitutional rights and agreed to speak with investigators. Gutzman said someone saw him going to the bathroom and thought he was masturbating. Gutzman explained there were no nearby bathrooms for him to use. Gutzman said he has difficulty urinating because of medical issues, and he displayed a motion with his hands when describing urinating.
Gutzman said he kind of squeezes his penis when asked for clarification. When asked if it looks like he is masturbating when he urinates, Gutzman replied, “It might, but I don’t’ know.” Gutzman acknowledged people saw him with his pants down. Gutzman said his penis would have been exposed for about 15 seconds. When asked if he rubbed his penis with his hands, Gutzman replied, “No, I wasn’t. Why would I do that if no one was around. The idea of exposing myself would be if someone was around.” Gutzman said he rubbed his penis to urinate more, but his penis wasn’t erect, and he wasn’t masturbating.
