On Saturday, December 6, 2025 at approximately 3:29 A.M., Ofc. S. Peterson of the Rochester Police Department observed a black 2013 Ford Edge (MN TAG 187) running with its lights on in a parking lot in the 700 block of North Broadway, City of Rochester, County of Olmsted, State of Minnesota. Ofc. Peterson drove through the parking lot and recognized LENARD DIONTE BOOTH [DOB REDACTED] sitting in the drivers seat. Ofc. Peterson knew that LENARD BOOTH was intoxicated due to a prior contact a couple hours earlier (25-62714). During the prior encounter, LENARD BOOTH was belligerent, uncooperative and appeared to be intoxicated.
Ofc. Peterson made contact with LENARD BOOTH. LENARD BOOTH had bloodshot, watery eyes, and was still argumentative and belligerent. Ofc. Peterson could smell alcohol emanating from LENARD BOOTH's face. LENARD BOOTH refused to cooperate with the horizontal gaze nystagmus test or any other field sobriety testing. Ofc. Peterson placed LENARD BOOTH under arrest. While at the Adult Detention Center, Ofc. Peterson read LENARD BOOTH the breath test advisory. LENARD BOOTH elected to speak with an attorney and that time began at 4:00 A.M. Ofc.
Peterson successfully reached and attorney and talked to them. LENARD BOOTH became difficult and pulled the cord out of the phone, and then requested a new cord for the phone. Ofc. Peterson plugged the phone back in and made sure it was working properly and advised LENARD BOOTH that the phone was working again. LENARD BOOTH again pulled the cord out of the phone and refused to use the phone. Ofc. Peterson then provided LENARD BOOTH with his mobile phone and a charger. However, LENARD BOOTH stated that he needed a wireless charger.
At approximately 4:30 A.M., Ofc. Peterson ended LENARD BOOTH's attorney time. Ofc. Peterson asked LENARD BOOTH multiple times if he would take a breath test. LENARD BOOTH's reply was that he would not make a decision until he spoke with an attorney. At a certain point, LENARD BOOTH was determined to have refused the breath test. Ofc. Peterson provided LENARD BOOTH with his notice of revocation, 3 ••-CR-••-•••• Filed in District Court State of Minnesota 12/8/2025 license plate impoundment and temporary permit.
When Ofc. Peterson opened the door to LENARD BOOTH's cell, he observed that LENARD BOOTH was on his mobile phone and sending text messages.
