Officers were provided a description of the vehicle, which was transporting the reported thief, who was identified as Dale Curtis Marks, [DOB REDACTED] (Defendant). Officers observed a vehicle matching the description provided. Officers initiated a traffic stop of this vehicle. Officers observed a passenger begin making furtive movements as though he was hiding something. The vehicle then came to a stop. Officers approached the vehicle. The passenger who had been making furtive movements was identified as Defendant.
Defendant admitted he had recently been with the theft victim (Victim). Officers observed a purse matching Victim’s purse’s description in the vehicle within reach of where Defendant had been located. The purse was searched and was missing $400.00 and a phone which Victim [NAME REDACTED] in the purse. The phone was reported to have a value of approximately $120.00. Other vehicle occupants were questioned. One occupant stated that Defendant had handed her Victim’s phone and told her “Merry Christmas.” She also stated that Defendant had handed her a methamphetamine pipe to hide.
This pipe was later tested, and it tested positive for methamphetamine residue. Defendant has a prior aggravating conviction in that Defendant was convicted of Drugs - Possession of Drug Paraphernalia - Use or Possession in 2014 in case number ••-CR-••-••••.
