On November 1, 2025, at approximately 11:00 PM, Deputy Brock Diedrich of the Chisago County Sheriff's Office was on patrol near North Branch, Chisago County, Minnesota when he observed two vehicles driving at a high rate of speed. The second vehicle was clocked traveling at 65 mph in a 55 mph zone. Deputy Diedrich followed this vehicle and observed it cross the fog line multiple times. A traffic stop was performed in the area of Forest Blvd. And Cougar Trl. In Chisago County. Deputy Diedrich approached the diver of the vehicle, identified as RACHEL RAE MILLER [DOB REDACTED], Defendant herein.
He observed that she had bloodshot, watery eyes, and an odor of intoxicating beverage was emanating from inside the vehicle. When asked how much she had to drink, she said she was coming from a wedding and had a couple of drinks. Defendant participated in standard field sobriety tests. During the HGN test she exhibited lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes, and nystagmus onset prior to 45 degrees in both eyes. During the walk and turn test, she failed to achieve and maintain the starting position, missed multiple heel to toe steps, stepped off line, made an improper number of steps, and performed an improper turn.
During the one leg stand test, she put her foot down, used her arms for balance, and swayed. Defendant provided a breath sample for a PBT which resulted in a.22 BAC. Defendant was arrested and taken to the Chisago County Jail. While at the jail, Defendant was read the Minnesota breath test advisory and used some time to contact an attorney. After her attorney time, Defendant provided breath samples at 12:24 AM to the DMT machine that read.19 BAC. Defendant has a prior DWI conviction from September 20, 2022 in court file ••-CR-••-••••.
