The Complainant having reviewed the applicable reports believes the following facts to be true: On or about September 12, 2025, at around 0227 hours, Officers with the St. Paul Police Department were dispatched to a motor vehicle collision in the area of [ADDRESS REDACTED] East, in St. Paul, Ramsey County, Minnesota. Upon arrival, officers observed a black Mazda motor vehicle (bearing MN Lic. Plate No. HTG203), with severe front end damages, in the middle of the construction zone on Maryland Avenue.
They also observed a male who was later identified as Benjamin LEE, [DOB REDACTED], Defendant herein, standing by the driver's side door, with blood on his shirt and arms. The airbags were deployed. Maryland Avenue had been divided into three (3) lanes with the northbound lane being blocked off for traffic heading westbound. Defendant explained that he was driving westbound on Maryland and did not see the construction. He was in the lane what ws blocked off by cones. He lost control of his vehicle when he struck an excavator that was parked on Maryland.
The excavator sustained minor damages. From their interaction with Defendant, the officers observed indicia of impairment: odor of alcoholic beverages on his breath, bloodshot/watery eyes, and slurred speech. Defendant admitted to drinking that night and that it was enough to be.08 or.05. Defendant refused the standard field sobriety tests. The officers administered the portable breath test to Defendant and obtained a reading of.27 BAC. Consequently, they arrested Defendant for DWI and transported him to Regions Hospital.
They obtained a search warrant for blood or urine test from the Honorable Ramsey County District Court Judge Adam Yang. They executed the search warrant and Defendant agreed to provide a blood sample which was drawn by a registered nurse at 0423 hours. The sample was later submitted to the BCA for testing. The blood test revealed that his alcohol concentration within 2 hours was.296 +/- 0.17 grams per 100 milliliter of blood. A record check showed Defendant had two (2) alcohol related [DL# REDACTED] from November 6, 2018 and May 2, 2017.
