On or about November 23, 2025, at approximately 12:19 AM, deputy Felmlee of the Washington County Sheriffs Office conducted a traffic stop on a vehicle in the area of I494 and Bailey Rd, City of Newport, Washington County, Minnesota. Prior to conducting the stop, the deputy observed a vehicle having trouble maintaining its lane. The vehicle also had an inoperable passenger side brake light. The deputy stopped the vehicle and identified the driver as PERFECTO YAHIR ROSALES HERNANDEZ, [DOB REDACTED], the Defendant herein.
Upon contact, the deputy noticed Defendant had glossy eyes and slurred speech, as well as a heavy odor of an alcoholic beverage emitting from the vehicle. The deputy also observed a partially full bottle of Corona beer sitting open in the center console. Defendant stated he did not have a Minnesota driver's license nor insurance. Defendant spoke little English but appeared to understand the deputy's questions. The deputy then used language line to access a Spanish translator. The deputy proceeded to conduct field sobriety tests, during which Defendant showed several signs of impairment.
A preliminary breath test showed Defendant's BAC to be 0.261. Defendant was placed under arrest and transported to Washington County Jail. Upon arrival at the jail, Defendant was read the breath test advisory using language line. Defendant stated he understand and consented to taking the test. Defendant produced a final breath sample with a BAC of 0.20 at 1:41 AM.
