Your complainant has reviewed police reports relating to the above-named defendant and the allegations contained herein. Based upon that information, complainant believes the following to be true and correct. On November 3, 2025, at approximately 8:15 P.M., Deputy David Moe, Pine County Sheriff's Office, was on patrol near the intersection of Hillside Avenue SW and Evergreen Square in Pine City, Pine County, Minnesota when he observed a brown Chevrolet Impala pass his location. He observed that the vehicle's high beams appeared to be on.
The vehicle turned left onto Hillside Avenue and went westbound on Pokegama Road. Deputy Moe began following the vehicle and determined the vehicle was traveling below the posted speed limit, which he thought was unusual. Deputy Moe noted that the vehicle did not dim the high beam lights for oncoming traffic. At that time, Deputy Moe initiated a traffic stop of the vehicle. Deputy Moe approached the vehicle and identified the driver as Nichol Deose. Deose admitted she did not dim the high beams on the vehicle while passing oncoming traffic.
Deose stated she did not have a valid driver's license. Deputy Moe determined that Deose's driver's license was revoked. Deputy Moe identified the passenger as DANIEL JAMES STEWART, [DOB REDACTED], the Defendant herein. Deose exited the vehicle at that time. Deose said they came from her residence in Pine City, stopped at the liquor store, went to Walmart, and then were traveling back to her home. Defendant reported similar travels. Defendant said there was a bottle of alcohol in front of him. Defendant's driver's license was suspended.
Defendant said he had been staying at Deose's residence. Deputy Moe noted that he was familiar with Deose's vehicle as being previously involved with illegal drug activity. He also was aware that Deose's address was a known drug house where methamphetamine and fentanyl are used. Deputy Moe previously arrested Defendant for fifth degree possession of a controlled substance. At that time, Deputy Moe asked Deose for consent to search the vehicle. Deose consented to the search, stating "I have nothing to hide." During the search, Deputy Moe located a white crystalline substance on the front passenger seat where Defendant had been sitting.
He recognized the substance based on his training and experience as methamphetamine. Deputy Moe also located a spoon and unused needle under the passenger seat. Deputy Moe recognized these items as commonly used to ingest methamphetamine. The white crystalline substance NIK tested positive for methamphetamine and had an uncertified weight of 1.5 grams. Defendant was convicted of gross misdemeanor fifth degree possession of a controlled substance in 2017 (••-CR-••-••••).
