Defendant was within one city block of a school, so Defendant was in a school zone. Officer was aware that Defendant at the time had multiple Winona County warrants for his arrest. Officer initiated an encounter with Defendant. Officer informed Defendant that he was under arrest due to the warrants. Defendant was cooperative with the arrest process. Defendant was searched incident to his arrest. A baggie containing a substance which appeared to be methamphetamine was located on Defendant’s person.
Defendant was then transported to the Winona County Jail. Officer later tested the substance contained within the baggie. The substance tested positive as methamphetamine. Officer weighed the substance and the baggie. The total weight of the methamphetamine was 1.6 grams. PLEASE TAKE NOTICE: Pursuant to Minn.
