On January 1, 2026, at approximately 10:36 am, officers were dispatched to a report of a domestic assault at a residence on Fremont Court SW in Rochester, Olmsted County, Minnesota. Officer Red Hill arrived on scene and met with Victim (adult female identified in police reports). Officer Red Hill observed multiple visible bumps, bruises, and injuries to Victim’s face and head when he made contact with her. Victim stated after she was assaulted that morning, she acted like she was going to walk the dog but fled to the neighbors and called the police.
Victim told Officer Red Hill that JOSE ALBERTO NUNEZ ([DOB redacted]) is her fiancé and they have six children together and there was one other child from a previous relationship that lived in the home. Victim disclosed that NUNEZ assaulted her the day prior and all the children were present during the assault. Victim stated the incident began on December 31, 2025, when she placed a stool up on the table where NUNEZ was sitting with one of the children. Victim explained she put the stool up on the table to prevent one of the other children from climbing on it and getting her.
Victim stated NUNEZ accused her of just being nosy and trying to see what he was doing on his phone. Victim stated NUNEZ then assaulted her. Victim described that NUNEZ punched her, grabbed her hair, threw her to the ground, and kicked her. Victim stated NUNEZ punched her in the ear and the head. Victim further described how NUNEZ grabbed her hair and threw her down. Victim stated NUNEZ would then get on top of her and push her face with his hand. Victim moved NUNEZ hand because it hurt her face.
NUNEZ would then put his knee on her face and push down. This caused a bump and bruise on her left cheek. Victim stated she believed NUNEZ punched her five to ten times. Victim stated she passed out from NUNEZ punching her in the head. Victim described having lumps and bumps in the hair covered areas of her head from being hit by NUNEZ. Victim stated the assault on 12/31/2025 took place in the kitchen, bedroom, and the living room. Victim state another assault took place that morning between 8:00 am and 10:00 am.
Victim stated that approximately 8:40 am, NUNEZ got upset with her because she did not get up with enough “pep” to start cleaning. Victim stated NUNEZ was also upset that she did not let the dogs out early enough. Victim stated she was still injured from the assault the day before. Victim stated NUNEZ slapped Victim across the face with an open hand. NUNEZ then punched her in the face with a closed fist. NUNEZ also threw Victim to the ground. Victim stated NUNEZ hurt her face, head, and elbow. Victim disclosed this assault took place in the kitchen and living room.
Officer Mendoza took a statement from Witness 1 (adult female identified in police reports). Witness 1 stated that at approximately 10:00 am, Victim showed up and stated she had been beaten up by her fiancé. Victim told Witness 1 she did not have a phone and Witness 1 let her use the phone to call police. Officers then attempted to make contact with NUNEZ. The door of the residence was locked. Officer Red Hill made contact with NUNEZ via phone. NUNEZ agreed to exit the residence and was taken into custody. 3 55-CR-26-19 Filed in District Court State of Minnesota 1/2/2026 After transporting NUNEZ to the ADC, Officer Red Hill requested that Officer Mendoza and Officer Hoklin return to speak to Victim to gather more detailed photos of Victim’s injuries.
