On May 25, 2025 at approximately 1:08 A.M., St. Cloud Police Department was dispatched to the Best Western Plus Kelly Inn, located in the City of St. Cloud, County of Stearns, State of Minnesota, on a report of a domestic assault. Through investigation, officers learned that the victim, [NAME REDACTED]A., adult female fully identified in police reports, had been assaulted by Benjamin Cecil Eaves, [DOB REDACTED], the defendant herein. The defendant and B. A. A. Are family or household members. Officer Orvis arrived at the hotel and made contact with B. A. A. Officer Orvis observed B. A. A. Was visibly upset.
B. A. A. Explained that the defendant has assaulted her in the past. B. A. A. Explained around 10:00 P.M. Or 11:00 P.M. On May 24, 2025 in the evening, an argument started between her and the defendant after she told him that she wanted to end their relationship. B. A. A. Explained the defendant became aggressive and started calling her names. B. A. A. Reported at one point she was standing by the door to the hotel room when the defendant grabbed her hair and pulled it, pulling her to the bed area.
B. A. A. Further reported that the defendant also bit her foot. B. A. A. Explained she was sitting in a chair and the defendant grabbed her ankle and pulled her, pulling her off the chair. B. A. A. Stated the defendant did this approximately three times. B. A. A. Reported feeling terrified of the defendant. Officer Orvis observed B. A. A. Had a red mark on her foot. Officers eventually made contact with the defendant. Officers observed the defendant had an odor of alcohol coming from him, had slurred speech, and appeared to be unbalanced on his feet.
A review of the defendant's criminal history reveals a prior conviction for Violation of a Domestic Abuse No Contact Order as contained in Hennepin County District Court File No. 27-CR-25-6, convicted on February 4, 2025, and a prior conviction for Violation of a Domestic Abuse No Contact Order as contained in Stearns County District Court File No. ••-CR-••-••••, convicted on October 2, 2023. Complainant has reason to believe and does believe that all of the above information is true and correct.
The above facts constitute your complainant's basis for believing that the above-named defendant, on or about the 24th day and 25th day of May, 2025 in the City of St. Cloud, County of Stearns, State of Minnesota, committed the offense(s) described herein.
