**This is a DVC matter.** On August 27, 2025, at approximately 11:11 A.M., Moorhead police officers responded to 1021 32nd Avenue South #317 in the City of Moorhead, County of Clay, State of Minnesota for the report of a domestic disturbance. Officers were advised that the caller, M. M. H. (hereinafter "Victim") was waiting with her daughter on the north side of the building. Dispatch advised that Demetrius Allan Martin [DOB REDACTED](hereinafter "Defendant") had threatened to kill the Victim [NAME REDACTED] had an order for protection.
Dispatch further advised that the Defendant held the Victim in her bedroom with a bat, hit her and talked about a gun. When officers arrived, they spoke with the Victim, [NAME REDACTED] on the previous night, the Defendant, with whom the Victim shares a child, had become verbally aggressive with her, stood over her with a bat and threatened to smash her kneecaps if she did not send him money. The Victim stated that she sent the Defendant $69 via Cash App. The Victim covered herself with a blanket so that if the Defendant hit her, it would not hurt as bad.
The Defendant then started pulling her hair, holding the blanket to the Victim's face, and then hit her with the back of his hand, striking her in her lip. The strike to the Victim's face caused an injury to the inside of her lip. While the Victim [NAME REDACTED], the Defendant called the Victim and said "you called the law?" and "you serious?" The Victim never saw a firearm in the Defendant's possession but believed he had access to one and believed it belonged to the Defendant's friend. The Victim [NAME REDACTED] was not free to leave her bedroom and not free to step out of her bed during the incident.
Officers did observe a bat in the Victim's bedroom. A search of the Defendant's criminal history shows the following qualified domestic related convictions for the purposes of enhancement: Threats of Violence on November 2, 2017 in Stearns County, MN (see court file 73-CR-17-8370); Domestic Assault on February 4, 2022 in Sherburne County, MN (see court file 71-CR-22-51) and Domestic Assault on February 28, 2024 in Clay County, MN (see court file 14-CR-23- 1378). The Defendant's criminal history further shows a conviction for Aggravated Robbery on September 4, 2009 in Stearns County, MN (see court file 73-CR-08-16712) and Domestic Assault on September 30, 2008 in Benton County, MN (see court file 05-CR-08-1114).
