On 11/21/2025 at approximately 11:18 P.M., Deputy Allan Oyaas of the Washington County Sheriff’s Office observed a vehicle traveling eastbound on Stillwater Road go through an intersection without stopping at a posted stop sign. Deputy Oyaas stopped the vehicle and the driver provided a valid MN Driver's License that identified himself as Robert Anthony Maietta [DOB REDACTED]. Robert stated that he was coming home from a hockey game. Deputy Oyaas could smell the odor of consumed alcoholic beverage coming from the vehicle and observed Robert had watery eyes.
Robert stated that he did not have anything to drink at the hockey game when asked. Deputy Oyaas ran Robert in DVS and his license came back with an ignition interlock restriction. There was a completion date for ignition interlock listed on 12/27/2024 for a DWI that occurred on 09/20/2024. The license still did not reflect the completion status. Deputy Oyaas had Robert step out of the vehicle to discuss the interlock with him. Robert stated that he was aware of the restriction but that he had completed the program and that the interlock was even removed from his personal truck.
While speaking with Robert away from the vehicle, Deputy Oyaas continued to smell the odor of consumed alcoholic beverages. Robert admitted that he had a beer about 10 minutes prior to being stopped. Deputy Oyaas instructed Robert on performing standardized field sobriety testing. Robert performed all of the tests and Deputy Oyaas observed Robert would use his arms for balance or lose his balance. Robert stated that he had a previous back surgery and that he occasionally has issues with his right leg, however this condition did not affect his normal day to day life.
No other medical conditions that could affect Robert's ability to walk or balance were reported. When asked to rate how intoxicated he felt on a scale of 1-10 with 10 being the highest, Robert rated himself at a 3. Robert provided a preliminary breath test sample of 0.097. Deputy Oyaas advised Robert that he was under arrest for DWI. Robert was arrested, searched, and transported to the Washington County Jail without incident. Robert’s vehicle was towed from the scene due to it being in a no parking zone.
Deputy Oyaas started the observation period at 11:55 P.M. And started the breath test advisory at 12:05 A.M. Robert elected to speak with an attorney and was able to speak with one after some time. The breath test advisory was completed at 12:49 A.M. Robert agreed to the breath test. Robert completed the breath test, which resulted in Blood Alcohol Concentration of 0.07 at 12:56 A.M. Robert had one prior DWI event when his criminal background was checked. Jail staff was advised to book and release Robert to a responsible party.
