On April 7, 2026, around 8:23 A.M., law enforcement observed a male later identified as Mario James Dupay [DOB REDACTED], defendant herein, pushing a motorcycle on the shoulder of the roadway in the area of Midway Street NE and 91st Avenue NE, Blaine, Anoka County. The motorcycle was a white 2017 KTM-390 with no license plates. Law enforcement stopped to speak with defendant who stated that the battery was low on the motorcycle, so he had to push it to his friend’s house. Defendant asked law enforcement to follow him to the residence of his friend located at 3209 91st Avenue NE, Blaine, Anoka County.
At the residence, defendant made contact with a male at the residence named Neil Ray Cape II [DOB REDACTED], Cape herein. Neither Cape nor defendant stated the motorcycle was theirs. Cape stated the motorcycle was a “friend’s” but did not name who the “friend” was. Cape then provided a “bill of sale” for the motorcycle which was handwritten and not an official bill of sale. Cape then said that this “bill of sale” was given to him when he bought the motorcycle. Cape also said the motorcycle “shouldn’t be hot.” Law enforcement ran the VIN on the motorcycle, and it came back as stolen out of Mendota Heights, Dakota County.
The motorcycle was stolen on February 6, 2026, from the registered owner, W. I. Defendant was arrested for being in possession of the stolen motorcycle. Defendant has a pending felony case in Anoka County court file no. 02-CR-26-1552 for possessing ammunition as an ineligible person and for possession of drugs in the fifth degree. In this case, defendant was released from the Anoka County jail on bail in the amount of $5,000 on March 19, 2026. To note, Cape is the co-defendant in this pending case as well.
