Investigators showed Smith photos of his Suburban and the piece he left behind at the scene. Smith insisted he wasn’t involved in any accident. Smith said he had a traumatic brain injury from a car accident that occurred when he was 18 that impacts his memory. Smith admitted he was the man in a photo when shown a photo taken from the Speedway surveillance video. Smith did not remember seeing a woman walking two German Shepherd dogs with her husband. Smith said he was at his mother’s house before he went to Speedway.
Smith said he typically uses GPS to get around to most places in St. Paul. Smith went to the gas station after he heard the yelling. Smith then said if he did hit someone, they must have stepped out quickly when he was driving, and he probably swiped and hit them. Smith did not remember anyone crossing the street. When investigators left the room, Smith looked at a photo of AD and said, “I’m sorry man. I do be driving over there, but I don’t remember hitting nobody—that’s crazy.” Investigators returned with a video recording that showed Smith’s Suburban leaving the crash scene at a high rate of speed.
Smith was also shown a video that showed the Suburban entering University Avenue from Beacon Street and almost driving in the wrong direction. Smith said, “I’m telling you the truth right now – I didn’t know I hit anybody, because you know the cones in the road – I did hit them.
