On January 5, 2026, at approximately 1:06 am, Brooklyn Park Police Officers responded to an apartment building located at 7100 85th Avenue North, Brooklyn Park, Hennepin County. The reporting party stated that there was a male in the apartment's parking lot that appeared to be prowling and near a gold Tahoe suburban with no front plate, and was still on scene. Officers responded and located the gold Tahoe matching the description of the call. Officers observed the male matching the description who appeared to see Officers and start walking quickly towards the entrance of the apartments from the direction of the gold Tahoe.
Officers stopped the male who stated that he was waiting for a friend to let him into the apartment. The male was identified as DUSTIE SHAWN FAY, Defendant herein. The Defendant stated that he was not associated with the Tahoe. Officers released the Defendant initially and he stood in the apartment vestibule appearing to wait for a tenant to let him in. Officers then learned that the Tahoe's back plates were not for the vehicle. The Tahoe's VIN on the front dash was covered with a piece of paper.
Officers suspected the Tahoe was stolen as it did not have front plates, the back plates came back to a gray Yukon and were not meant for the Tahoe, and the VIN number was covered preventing an Officer from confirming if the vehicle was stolen. Officers learned that the Tahoe was unlocked and opened the door to check the VIN. Officers confirmed that the vehicle was stolen. In an inventory search of the vehicle, Officers located court paperwork with the Defendant's name on it - showing he was associated with the Tahoe despite him denying he was.
The Defendant was still in the vestibule during the Tahoe's investigation. Officers made contact with him again and he was placed under arrest. In a search of the Defendant, Officers located a replica firearm lighter. Officers made contact with the apartment's management and learned the Defendant and two other individuals have been squatting in a vacant apartment of the building without permission over the past week. Officers were provided surveillance of the Defendant in the vehicle on January 2nd and 3rd, 2026. In the video, he was wearing the same shoes and coat he was arrested in.
The Defendant has a pending Conditional Release Violation in case file ••-CR-••-••••. The Defendant has been out of contact with Conditional Release Officer M. C. Since January 6, 2026, and therefore, the State requests this complaint issue as a warrant.
