A sworn officer of the St. Cloud Police Department duly states the following facts establish PROBABLE CAUSE: On or about April 11, 2025, at approximately 10:10PM, officers were dispatched to a driving while intoxicated complaint at Dairy Queen, located at 611 Highway 10 South, City of St. Cloud, County of Benton, State of Minnesota. The complainant advised that there was an intoxicated female who got her vehicle stuck in a snowbank in the back part of the parking lot. Upon arrival, Officer Shea Rosha observed a silver Toyota Yaris bearing Minnesota license plate [PLATE REDACTED] stuck in a pile of snow.
A female, and lone occupant of the vehicle, later identified by her Minnesota driver's license as Sarah Elise Grosland, [DOB REDACTED], the Defendant herein, was sitting in the front passenger seat. Officer Rosha observed the vehicle's keys to be in the ignition with the vehicle turned off. Upon making contact with the Defendant, Officer Rosha observed an overwhelming odor of breath alcohol coming from inside the vehicle. The Defendant denied driving the vehicle. She attempted to remove the vehicle's keys from the ignition three times but was unable to because the vehicle was in reverse.
Officer Rosha observed the Defendant's eyes to be watery and her speech slurred. Once she exited the vehicle, Officer Rosha could smell the odor of alcohol coming from her person. Officer Rosha requested that the Defendant perform standardized field sobriety tests. The Defendant initially agreed, but failed to comply with Officer Rosha's requests. Officer Rosha administered a preliminary breath test. Results indicated that the Defendant had a breath alcohol concentration of.330. Officer Rosha placed the Defendant under arrest for suspicion of driving while impaired and transported her to the St. Cloud Police Department.
At 11:01PM, Officer Rosha read to the Defendant the Minnesota Breath Test Advisory. The Defendant acknowledged that she understood and wished to consult with an attorney. The Defendant made no attempt to contact an attorney. During the attorney time, the Defendant reached across the table, slammed Officer Rosha's laptop closed, and stated, "I will punch you in the throat." Officer Rosha ended attorney time at 11:30PM. The Defendant agreed to take the Breath test but when given the opportunity to provide a breath sample, the Defendant failed to comply.
Officer Rosha deemed the Defendant's failure to comply a test refusal. Officer Zachary Scholl made contact with the complainant, [NAME REDACTED]A., fully identified in the police report, over the phone. J. J. A. Advised that he observed the Defendant to be stuck in the snowbank. She was seated in the driver's seat, attempting to get out of the snowbank, when he arrived on scene. J. J. A. Stated that he observed the Defendant to exit the driver's seat of the vehicle and approach him, asking him for help.
