On September 4, 2025 Det. John Marshall of the Oakdale police department received two CyberTips reporting the distribution of known child sexual abuse material (CSAM) from the National Center for Missing and Exploited Children. One tip was from X Corp (Twitter) and the other Discord. On December 30, 2024 at approximately 11:55pm UTC, X ("Twitter") username: tenpice ( later identified as James Lamarr Tate [DOB REDACTED] "Defendant")shared a file ending in 0b6c1 which showed a pre- pubescent female (approximately 6-9 years old) with her legs in the air, while using a red object to penetrate her vagina.

The image contained the text "contact me: ponprade.cc" Officers also located a direct message exchange between Defendant and another user on December 30, 2024. In that exchange Defendant sent the unknown user an image of a pre-pubescent female, with someone's hands on the female's buttocks, pulling the vagina open. The unknown user asks Defendant "how old is she" Defendant then replies "not sure, but probably like 8?" In its initial report to the NCMEC Twitter included the account information, which showed that on November 16, 2024 the account name had been changed from "James3776799171" to "tenpice." File ending in 40cf2 showed a child approximately 2-5 years old being held on a bed while an unknown male penetrates them 2. File ending in 6f98e showing pre-pubescent male, approximately 4-8 years old, being held over by an unknown male, who tries to penetrate him anally 3. File ending in ab2b showing a female, approximately 2-4 years old, on her back, while a woman preforms oral sex on the child. 4. File ending 56a81 showing a pre-pubescent female, approximately 6-10 years old) laying on her back across adult female legs, while being penetrated by an adult male 5. File ending 36935 which showed a female 3-5 years old, stroking a male penis with both hands, as the male tries to push her face closer to his penis.
