Officers received a report from dispatch that an adult male had just left a bar in a white Buick (“Vehicle”) traveling westbound on 5th Street. The caller reported that the driver was under the influence of alcohol and cocaine. Officers observed Vehicle on 5th Street and confirmed it had the same license plate as the reported vehicle. Officers began following Vehicle. Officer observed Vehicle’s brake lights flutter multiple times as it came to a stop sign. Vehicle turned into a gas station. Based on the information from the citizen reporter and the driving conduct, Officers conducted a traffic stop of Defendant.
Officers approached Vehicle and made contact with the driver, who was identified as Caleb Joseph Gasper, [DOB REDACTED] (“Defendant”). Defendant told Officers he had just left the bar and was on his way home. Defendant had bloodshot, watery eyes and had a faint smell of a consumed alcohol beverage. Officers observed an open container of an alcoholic beverage in the driver’s side door panel. Defendant was asked to get out of Vehicle. Defendant fumbled with the door panel, saying he had dropped his cigarette.
As Defendant began to exit Vehicle, he dropped his phone on the ground. As Defendant dropped his phone, Officers saw a small baggie containing a white powdery substance in his right hand that was previously hidden behind his phone. Defendant then dropped the baggie on the ground. Officers suspected the substance was cocaine. Defendant was placed in handcuffs. Defendant told Officers he had consumed part of one alcohol beverage and admitted he had been consuming marijuana. Defendant’s speech was rapid and jittery.
Defendant was taken out of handcuffs and asked to perform Standardized Field Sobriety Testing. Officers performed the HGN test. Officers observed equal tracking and lack of smooth pursuit in both of Defendant’s eyes, distinct and sustained nystagmus at maximum deviation in both of Defendant’s eyes, and nystagmus prior to 45 degrees in both of Defendant’s eyes. Officers had Defendant perform the walk and 2 85-CR-26-56 Filed in District Court State of Minnesota 1/12/2026 turn test. Defendant failed to maintain the instructed position stance during the instruction phase of the test, Defendant used his arms for balance, and Defendant performed an improper turn.
Officers had Defendant do the one-legged stand test. Defendant put his foot down during the test and swayed while balancing. Officers gave Defendant a PBT, which showed 0.05% BAC. Defendant admitted the substance in the bag in his hand was cocaine. Defendant was arrested for possession of a controlled substance and suspected DWI. Defendant was transported to the Winona County Jail so a full DRE evaluation could be conducted. Officers conducted a DRE evaluation at the jail. Based on the DRE evaluation, Officers concluded that Defendant was under the influence of a CNS Depressant and a CNS Stimulant.
