On or about January 30, 2026, at approximately 7:35 P.M., Metro Transit officers watching cameras at the Lake Street Station located at [ADDRESS REDACTED] East in Minneapolis, Hennepin County, Minnesota, observed an adult male, later identified as KEVIN DEWAYNE YORK, JR. (“Defendant” herein) smoking off of foil at the top of the south tower stairs. Officers reviewed video from minutes earlier and observed Defendant take three small baggies out of his pocket that appeared to contain white powder. Defendant set these baggies on top of the stairs, smoked something from the baggies off of foil, and put the baggies back in his pocket.
Given that smoking from foil is a common way to ingest fentanyl, officers believed the baggies in Defendant’s pockets may contain fentanyl. Defendant walked to the north tower, where officers detained him. Officers informed Defendant they believed he had narcotics, and Defendant gave his consent for officers to search him. Officers recovered a can of tear gas containing “oleoresin capsicum” as well as multiple items of drug paraphernalia. Defendant is prohibited from possessing tear gas due to the following prior conviction(s) for crimes of violence: • ••-CR-••-••••: convicted of felony Third-Degree Assault on July 19, 2023 Defendant remains in custody.
