On May 22, 2026, at approximately 5:53 A.M., officers were called to the report of a two-vehicle crash at the intersection of Cedar Avenue and 179th Street West in the City of Lakeville, County of Dakota, State of Minnesota. Officers responded and located a white Lexus SUV with front end damage and a gray Ford Escape with rear end damage approximately 130 feet past the intersection. Officers spoke with the driver of the Lexus, who was identified as MCHAEL TIMOTHY TERBILCOX [DOB REDACTED]. TERBILCOX told officers that the driver of the other vehicle was injured.
The driver of the other vehicle was identified as Victim 1 and was bleeding from her head. Victim 1 also told officers that she could not move or feel her legs. Victim 1 was transported by ambulance to the hospital. Prior to being transported, Victim 1 told officers she was stationary at the red light northbound on Cedar Avenue when she was rear-ended. TERBILCOX told officers he was heading northbound on Cedar Avenue approaching the intersection. TERBILCOX believed the light would turn green, so he did not break, hitting the back of Victim 1’s vehicle.
While speaking with TERBILCOX, officers noted he had slurred/delayed speech, poor balance, and could not follow officers’ instructions. Officers conducted standardized field sobriety tests on TERBILCOX and determines there was a basis to arrest him for driving under the influence of a controlled substance. During a search incident to TERBILCOX’S arrest, officers located a pill bottle containing amphetamine pills, which were prescribed to TERBILCOX, as well as a THC vape, and two partial pills, one pink and one white.
During a search of TERBILCOX’S vehicle, officers located a pill crusher with pink residue, fifteen pink pills identified as amphetamine and dextroamphetamine, both Schedule II controlled substances, and a cut straw with pink residue. The pill bottle containing the pink amphetamine pills did not carry a prescription. TERBILCOX was transported to the police department where he waived his Miranda rights and agreed to undergo a drug recognition evaluation. During that evaluation, the officer noted that TERBILCOX’S pulse was consistently over 130 beats per minute, his blood pressure was elevated, and he had body tremors.
The officer also noted TERBILCOX’S nostril appeared red and had a red spot, which the officer knew from his training and experience indicates ingestion of substances by nose. Based on their evaluation, the drug recognition evaluator concluded that TERBILCOX was under the influence of a 2 19HA-CR-26-738 Filed in District Court State of Minnesota 5/26/2026 central nervous system stimulant and cannabis. A search warrant was obtained to draw TERBILCOX’S blood, which was executed, and the sample sent to the Minnesota Bureau of Criminal Apprehension.
