In Itasca County Court file ••-CR-••-•••• Brian Roger Wesley is charged with one count of Felony Fifth Degree Controlled Substance Possession. Defendant made his first appearance in Court on the above file on May 30, 2025, at which time the Court notified Wesley that failure to appear for a court appearance is a criminal offense. Bail was ordered in the amount of $20,000 without conditions, $10,000 with conditions, or ROR with color code. Defendant was ordered to appear for Rule 8 hearing on July 2, 2025. On November 19, 2025, Defendant pled guilty and was released on conditions. He was ordered to cooperate with a pre-sentence investigation and appear for an in person sentencing hearing on January 29, 2026 at 9:00 A.M. Defendant failed to cooperate with the pre-sentence investigation.
He also failed to appear for sentencing on January 29, 2026, at which time another body only warrant was issued for his arrest. On March 3, 2026, Defendant was arrested on his outstanding warrant and booked into the Itasca County Jail. On the morning of March 4, 2026, Investigator Brian Mattson of the Grand Rapids Police Department met with Wesley and read him the Miranda Advisory. Wesley agreed to speak with said Investigator. During their conversation, Wesley acknowledged that he knew he had a warrant out for failing to cooperate with his pre-sentence investigation and failing to appear for sentencing.
When Investigator Mattson asked Wesley why he had not shown up for sentencing, he stated it was because he could not get his Zoom to work properly and that he had "missed the time for court". Wesley stated that he should have just come down to the courthouse, but assumed that he had a warrant out for him at that point.
