On January 23, 2026, at approximately 11:52 P.M., an officer with the South Saint Paul Police Department was on patrol in her squad vehicle on 19th Avenue North, South Saint Paul, Dakota County, Minnesota. Upon approaching an intersection with Bromley Street, an intersection controlled by a stop signs in all directions, the officer saw a motor vehicle stopped at the stop sign. The officer waited for the motor vehicle to drive since it had the right of way. After waiting several seconds, the officer noticed the vehicle did not move.
The officer noticed other motor vehicles stopping behind the first motor vehicle. The officer drove behind the motor vehicle. After waiting a few more seconds with the motor vehicle not moving, the officer executed a traffic stop. Next, the officer approached the vehicle on foot and saw a person slumped over behind the steering wheel. The officer requested backup. The officer noticed the person, later identified as COLE DOUGLAS BROMS [DOB REDACTED], being to wake up. When BROMS woke up, the vehicle jerked forward but BROMS stopped the vehicle.
The officer identified herself. The officer spoke with BROMS as to why he was sleeping behind the wheel. While speaking with BROMS, the officer noticed BROMS had constricted pupils. BROMS indicated that he was tired. BROMS agreed to perform field sobriety tests. BROMS completed five tests. The officer noticed signs of possible impairment on some of the tests, including swaying back and forth during one of the tests, failure to follow instructions, and lack of balance. The officer arrested BROMS on suspicion of driving while impaired (DWI). After arresting BROMS, the officer returned to the motor vehicle.
The officer looked around the area where BROMS had been sitting and saw a baggie containing a substance. The officer noticed that the baggie was torn so that the substance was slightly poured out. The officer also noticed a disassembled burnt pen, which she recognized as possible drug paraphernalia. Next, the officer noticed another baggie in a compartment beneath the radio. The officer saw pieces of tinfoil next to the second baggie, which she recognized as possible drug paraphernalia. 3 19HA-CR-26-479 Filed in District Court State of Minnesota 4/3/2026 A substance located inside the motor vehicle later field tested positive for the presence of cocaine, a Schedule II controlled substance, and weighed approximately 0.95 grams.
The officer transported BROMS to the police department. Once there, the officer applied for and obtained a search warrant for a blood or urine sample from BROMS. BROMS agreed to provide a blood sample. The Minnesota Bureau of Criminal Apprehension analyzed BROMS’s blood sample and determined that it contained fentanyl and norfentanyl.
