On November 24, 2025, at 8:12 P.M. Troopers with the Minnesota State Patrol responded to a report of a motor vehicle crashing into the cable barriers on southbound Interstate 35 East at County Road 42 in the City of Burnsville, Dakota County Minnesota. The State Patrol Dispatchers then observed the driver of that vehicle, later identified as the above named defendant, Darryl Houston Marshal Ross, get out of the vehicle and begin to run around erratically and across the freeway. The dispatchers were able to follow the defendant on traffic cameras until the troopers contacted him on County Road 42 at Nicollet Avenue.
The defendant made very erratic body movements and was unable to focus on the trooper’s questions, unable to sit still and kept constantly moving and fidgeting. He admitted to consuming alcohol and prescribed oxycodone. The trooper smelled a strong odor of a consumed alcoholic beverage emanating from the defendant, the defendant’s eyes were bloodshot and watery, the defendant was profusely sweating and had steam coming off the top of his head, and his skin was warm to the touch, his muscles were flexed, his verbal responses were incomplete thoughts and sentences, his breathing was heavier than normal, and he was paranoid.
Based upon these observations, the trooper formed the opinion that the defendant’s ability to drive a motor vehicle was impaired. The defendant’s pulse was elevated while he was in the ambulance. At the hospital the defendant continued to act erratically and backed into a corner and appeared as if he wanted to fight. The defendant said he did not need medical attention and wanted to leave the hospital. The troopers attempted to handcuff the defendant, and the defendant started to pull away from them.
The defendant tensed his muscles and continued to resist being handcuffed. The defendant was eventually able to be handcuffed by the troopers. A search warrant was obtained, and a sample of the defendant’s blood was drawn for testing at the Minnesota Bureau of Criminal Apprehension. At the Dakota County Jail, the defendant told the trooper that he “might” have something in his pocket. The trooper removed a bag containing a white powder from the defendant’s pocket. The white powder was later preliminarily tested, and the test indicated the presence of fentanyl, and it weighed 0.4 3 19HA-CR-25-2040 Filed in District Court State of Minnesota 11/26/2025 grams.
The defendant was convicted of Driving While Impaired on April 15, 2023. His Minnesota driving privileges were revoked on August 11, 2025, after submitting to a blood test and cancelled on November 19, 2025, for being Inimical to Public Safety.
