On or about March 23, 2026, at approximately 1719 hours, a female (victim) contacted a Fergus Falls Police Department officer in the police department parking lot. The victim wanted to report that DANIEL MIGUEL RUSH, [DOB REDACTED], the defendant, had taken her vehicle on Saturday night and was now refusing to return it to her. The victim [NAME REDACTED], which was March 21, 2026, the defendant had come into a residence located in Fergus Falls, Otter Tail County, Minnesota, and was upset with the victim.
The victim said when the defendant asked to take the vehicle, she had initially said no. The victim described that the defendant ripped the keys out of her hand, pushed her, and then left the residence. The victim stated the defendant agreed to bring the vehicle back the following day. The victim [NAME REDACTED] was happening, the defendant was openly smoking methamphetamine, and the victim was not okay with that. The officer attempted to call the defendant, leaving him a voicemail indicating the victim wanted her vehicle returned by the following morning.
The officer also sent the defendant a text with the same request to return the vehicle or there could be charges. The victim indicated that she wanted to go to the defendant’s place of employment in Fergus Falls to retrieve the vehicle. The victim [NAME REDACTED]. At approximately 1739 hours on March 23, 2026, Fergus Falls Police Department officers were dispatched to the defendant’s place of employment. The caller was the defendant, stating he was in a verbal dispute with a female. Upon arrival at the defendant’s place of employment, an officer made contact with the victim.
The victim [NAME REDACTED] had physically assaulted her and then fled back into his work. The victim described that when she arrived at the defendant’s work, he was sitting inside the vehicle she had wanted to report stolen. The victim described that the defendant exited that vehicle and ran up to the vehicle she had arrived in; the defendant was yelling at her. Eventually, the defendant was reaching inside, grabbed the victim’s hair, and was yelling, “Give me the title!” While the defendant was trying to take the title from the victim, [NAME REDACTED]. The victim [NAME REDACTED] one point the defendant put his hands around her neck.
The victim pulled down her sweatshirt collar, where the officer observed significant redness at the base of the victim’s neck and upper chest area. The victim and the defendant have been in a romantic relationship for approximately 14 months. Witness #1 and Witness #2 provided a similar accounts to an officer. They said that the defendant came over to the vehicle, reached inside, and began putting his hands on the victim in the area of her neck. One of the witnesses described the defendant putting the victim in a headlock.
An officer went into the defendant’s place of employment and made contact with him. The defendant said he called law enforcement because he had lived with the victim for approximately a year and their relationship was not working out. The defendant claimed the victim was stealing his television and other items, and they were also having a vehicle dispute. The defendant claimed that at his workplace, the victim had threatened to take his vehicle if he did not go with her. The defendant agreed that there were two people in the vehicle with the victim that would have observed the interaction.
