On January 12, 2026, at 12:38 A.M., a Burnsville Police Officer was on routine patrol in the area of Burnhaven Drive and Southcross Drive in the City of Burnsville, Dakota County, Minnesota, when he made a U-turn to follow a vehicle that was southbound on Burnhaven Drive as it approached Southcross Drive. The vehicle made an abrupt lane change from the left lane to the right lane of southbound Burnhaven Drive as it came to a stop at the stoplight. At the stop light the driver, later identified as the defendant Kelly Kay Dale, activated the vehicle’s right turn signal and made a right turn onto Southcross Drive.
The officer then activated his emergency lights and stopped the vehicle for failing to signal the lane change and right hand turn 100 feet prior to making the turn. The defendant was the driver and lone occupant of the vehicle. The officer had previously checked the defendant’s Minnesota driving privileges and learned they were suspended. While speaking to the defendant at her vehicle, the officer observed that defendant could not sit still and could not control her body movements. The defendant denied using any methamphetamine or any other controlled substance.
Because of the defendant’s hyperactivity, talkativeness, grinding of her teeth, and exaggerated body movements, the officer had the defendant step out of the vehicle to perform field sobriety tests. Once outside of the vehicle, the defendant continued to have exaggerated body movements and needed to use the vehicle to maintain her balance. The defendant passed the horizontal gaze nystagmus test. The defendant failed the walk and turn test and one leg stand test. She could not lift either leg off the ground.
The officer then placed the defendant under arrest for driving while impaired. In the defendant’s motor vehicle, a sergeant located a purse on the passenger seat. Inside of the purse were eight plastic bags, each containing one pink pill. The eight pills were identified by their markings on a drug identification website as containing Amphetamine, a Schedule II controlled substance. In seven of the eight bags was one blue pill, identified as containing Amphetamine, a Schedule II controlled substance.
There was a total of 15 amphetamine pills. A search warrant was obtained, and a sample of the defendant’s blood was taken for testing at the Minnesota Bureau of Criminal Apprehension.
