On March 8, 2026, at approximately 3:02 A.M., an officer with the South Saint Paul Police Department stopped a motor vehicle near Concord Street South and Armour Avenue, South Saint Paul, Dakota County, Minnesota. The officer stopped the vehicle because it had touched or crossed the fog line. After the vehicle stopped, the officer approached the vehicle and spoke with the driver and sole occupant, identified as DONALD ALLEN SHERRY [DOB REDACTED]. The officer told SHERRY why she conducted the stop.
While speaking with SHERRY, the officer noticed that SHERRY exhibited signs of nervousness, including shaking hands. The officer also noticed that SHERRY handed over a document regarding “laboratory results” in lieu of his driver’s license. Eventually, SHERRY was able to produce his driver’s license. The officer returned to her squad vehicle to run routine checks. The officer noticed that SHERRY had several drug-related prior criminal convictions. The officer reapproached the vehicle to speak with SHERRY further.
The officer asked SHERRY to exit the vehicle. SHERRY complied. After asking SHERRY about drug and alcohol use, SHERRY agreed to perform field sobriety tests. SHERRY completed five tests. The officer noticed signs of possible impairment on some of the tests. Based on all her observations, the officer arrested SHERRY for driving while impaired. During a search of SHERRY’s person incident to arrest, an assisting officer located, among other things, a baggie containing a substance. The substance field tested positive for the presence of methamphetamine, a Schedule II controlled substance, and weighed approximately 2.66 grams.
The officer transported SHERRY to the police department. Once there, the officer applied for and obtained a search warrant for a blood sample from SHERRY. SHERRY agreed to provide a blood sample. The Minnesota Bureau of Criminal Apprehension analyzed the sample and determined that it contained cocaine, benzoylecgonine (a metabolite of cocaine), amphetamine, and methamphetamine. 3 19HA-CR-26-575 Filed in District Court State of Minnesota 4/21/2026 In a statement, SHERRY admitted to drug use. SHERRY has six felony convictions in Minnesota under Chapter 152.
