On May 24, 2026, at approximately 11:23 pm, officers with the Burnsville Police Department were dispatched to an apartment complex located at [ADDRESS REDACTED] in Burnsville, which is within Dakota County, for a suspicious person call. Dispatch advised that a resident of the apartment complex had received a notification from her Tesla vehicle that it was being tampered with, and that the suspect was a black man wearing a white shirt, light gray shorts with compression leggings underneath and flip flops.
Officers located and made contact with Dayon Daquon Presley [DOB REDACTED], hereinafter “Defendant.” Defendant matched the description of the suspect who had tampered with the Tesla. Defendant stated that he was at the apartment complex visiting his girlfriend, but he was not able to provide any identifying information for her. Additionally, security footage obtained from the apartment complex showed Defendant standing in the apartment complex’s underground garage attempting to open multiple parked vehicles.
Defendant was initially given a citation for trespassing and released from the scene. At 1:49 am, Burnsville officers responded to another call, this time for a man trespassing at [ADDRESS REDACTED] East, which is also in Burnsville and within Dakota County. Defendant was found trespassing inside a condominium and was placed under arrest. Defendant was searched incident to arrest and a wallet was found on his person. That wallet contained six financial transaction cards belonging to J. C. P., hereinafter “Victim,”, as well as four prepaid Mastercard debit cards worth $50 each.
Officers subsequently determined that Victim resided at [ADDRESS REDACTED] where Defendant had been found trespassing a few hours earlier. Officers made contact with Victim who informed officers that he had left his wallet in his wife’s vehicle, which was parked in the same underground structure where Defendant had previously been seen attempting to open vehicles, and that his cards had been used without his consent. Additionally, it was determined that Victim’s financial transaction cards had been used to make three purchases, which included various food items as well as four $50 prepaid Mastercard debit cards at a Cub Foods located at [ADDRESS REDACTED] East between 1:03 am and 1:10 am, for a total of $240.32. This grocery store is close to the second location where Defendant was found trespassing and the items purchased are consistent with the items found on Defendant’s person, and near him at the time of his second arrest. 3 19HA-CR-26-748 Filed in District Court State of Minnesota 5/27/2026 From the information available to law enforcement, it is understood that Defendant entered the underground garage at [ADDRESS REDACTED] without permission, either before or after his initial contact with law enforcement, stole Victim’s financial transaction cards out of his wife’s vehicle, and then used them to make various purchases, before being located by law enforcement the second time.
