Criminal Damage to Property
Allegations of intentionally damaging or destroying another person's property without their consent.
Max penalty: Up to 5 years in prison and/or $10,000 fine (first degree, including damage over $1,000); up to one year and a day in prison and/or $3,000 (second degree, bias-motivated damage); up to 364 days in jail and/or $3,000 (third degree, gross misdemeanor); up to 90 days in jail and/or $1,000 (fourth degree, misdemeanor)Minn. Arson - 2nd Degree
Allegations of intentionally setting fire to an unoccupied building, or to any property with intent to defraud an insurer.
Max penalty: Up to 10 years in prison and/or $20,000 fineMinn. Stat. § 609.562
Arson - 1st Degree
Damage by fire or explosives that the law treats as first-degree arson. Depending on the count, prosecutors allege the person intentionally destroyed or damaged a dwelling or a building belonging to or connected with one, whether or not anyone was inside. Other counts involve another building where the person knew someone was present or where someone's presence was a reasonable possibility. Others involve another building where flammable material was used to start or accelerate the fire.
Max penalty: Up to 20 years in prison and/or $35,000 fine (another building where a person is present or could reasonably be); up to 20 years and/or $20,000 (a dwelling, or a fire started or spread with flammable material)Minn. Stat. § 609.561
