Based on reports from an incident occurring on or about January 18, 2025, your Complaint offers the following to establish probable cause: At approximately 11:00 P.M. On January 18, 2025, Cottage Grove Police Officers received a driving complaint involving a blonde female operating a small black sedan. Officers were advised the female was passed out in the driver seat of a car with her head rested on the steering wheel. The caller told dispatch that he spoke with the female and she claimed to "ok". The caller said that he observed burnt tin foil inside the car when speaking with the female.
Officers responded to the area and located ARIANNA DIANE BURKE [DOB REDACTED] inside a parked car in the driveway located at 103rd Grey Cloud Trail South in the City of Cottage Grove, Washington County, State of Minnesota. BURKE said she was checking her mailbox that is located at the end of a long driveway. BURKE had ash on her face and teeth, which officers believed was due to her smoking an unknown illegal substance. Officers had BURKE exit the car and he noticed a small purple tube on the drivers seat.
The officer also observed multiple pieces of burnt tin foil scattered around the inside of the car. BURKE admitted that she had just smoked marijuana prior to driving. Officers had BURKE perform standardized field sobriety tests. BURKE's pupils were dilated and she showed clues of impairment. During the modified Romberg test, BURKE eyes fluttered. BURKE's eyes failed to converge during the administration of the Convergence test. BURKE was transported to the Cottage Grove Police Department where she failed a drug recognition evaluation (DRE). BURKE again admitted to smoking marijuana and also said she had smoke fentanyl earlier that day.
Officer obtained a search warrant authorizing the collection of a sample of BURKE's blood or urine. A sample of BURKE's blood was collected and sent to the Minnesota Bureau of Criminal Apprehension (BCA). The BCA reported that BURKE's blood sample contained fentanyl. Additionally, during a search of BURKE's person, officers located.597 grams of substance that tested positive as containing fentanyl.
