Two adult individuals reside at the residence, MAGGIE ELIZABETH USELTON [DOB REDACTED], and MASON WILLIAM BROWN [DOB REDACTED], defendants herein. USELTON has a minor child, [DOB REDACTED], who also resides at the residence. The officers made contact with BROWN and USELTON in their vehicle as they arrived at the garage at the residence. When the officers were removing BROWN and Uselton from the vehicle they observed that BROWN appeared to be heavily under the influence of a controlled substance and there was an overwhelming chemical odor consistent with fentanyl being consumed in the vehicle.
The officers noted that there was a car seat in the rear of the vehicle. The officers arranged for a relative of USELTON to take custody of the child, who would normally have been returning to the residence after school. A search of the vehicle resulted in the discovery of a plastic container with a white powder substance that field tested positive for both cocaine and fentanyl, and weighed 1.0 grams without packaging. This was located in the center console of the vehicle next to where BROWN was seated.
A purse belonging to USELTON was found in the vehicle. Inside the purse was a plastic container that contained a substance that field tested positive for the presence of both cocaine and fentanyl and weighed 2.14 grams without packaging. USELTON'S social security card and driver's license were also located inside the purse, along with a scale and narcan. USELTON provided a Mirandized statement in which she admitted to using fentanyl in the morning the day the warrant was executed, and that she would have fentanyl and other drug contraband in her purse.
She indicated that BROWN had been smoking fentanyl in the vehicle that day, that she and BROWN smoke fentanyl in the vehicle and that her five year old child rides in the same vehicle. A search of the residence resulted in the discovery of a plastic container with a white powder substance inside it located on a coffee table in the living room. USELTON stated it was makeup. The substance field tested positive for cocaine. A digital scale with white powder residue simialr to the cocaine was located under the coffee table.
These items were within reach of a five year old child. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
