On November 6, 2025, at approximately 10:10 AM, Cmdr. Sam McGinnis, along with other officers from the Mankato Department of Public Safety, were dispatched to a multivehicle personal injury accident at the intersection of Victory Drive and Adams Street in the City of Mankato. Capt. McGinnis was the first officer on the scene, he and fire personnel attended to the three drivers involved. Capt. McGinnis observed Mankato Fire Capt. William Bowser interacting with a driver identified as Brett Andrew Dvorak.
It would later be learned that Dvorak ran a red light causing the accident. Capt. Bowser advised Capt. McGinnis that he had seen Dvorak consume a large quantity of marijuana gummies. Dvorak’s arms were held to his side to prevent him from consuming additional substances. Cmdr. McGinnis noted that Devorak had pinpoint pupils, slow reactions and slurred, incoherent speech. Based on his observations, Cmdr. McGinnis believed Dvorak to be impaired. Ofc. Colton Pike arrived at the scene and assumed responsibility for the impairment investigation.
Upon arriving at the scene, Ofc. Pike observed several vehicles with significant damage sitting in the intersection blocking traffic. Victim 1 was sitting on the curb at the northeast corner of the intersection and would later be taken to the hospital to have his injuries addressed. Ofc. Pike saw Dvorak sitting in the driver seat of his vehicle with two Mankato firefighters physically holding Dvorak’s arms. Ofc. Pike was advised that Dvorak was being obstructive and fighting with emergency responders.
Ofc. Pike was also advised that Dvorak was displaying signs of impairment including very constricted pupils. It was noted that a large number of pills had been thrown about the front driver's seat/floor area of the Dvorak’s vehicle. Ofc. Pike was also informed that Dvorak had ingested a number of marijuana gummies. Ofc. Pike assisted Dvorak out of the vehicle and attempted to administer standardized field sobriety tests to him. Ofc. Pike administered a PBT, the result being.000. Ofc. Pike explained the instructions for the horizontal gaze nystagmus test to Dvorak but Dvorak was unable to follow simple commands.
Due to the Dvorak’s uncooperativeness, Ofc. Pike was unable to administer additional standardized field sobriety tests. Dvorak became increasingly uncooperative to the point that Dvorak started shouting vulgarities at Ofc. Pike While speaking with Dvorak, Ofc. Pike observed that Dvorak’s eyes were extremely constricted, his eyes were bloodshot and watery, and his eyes were glazed over. Dvorak was placed in handcuffs and transported to the hospital. Ofc. Pike applied for a search warrant for a sample of Dvorak’s blood.
The search warrant was reviewed and approved by a judge of the Fifth Judicial District. A sample of Dvorak’s blood was taken and will be sent to the BCA for analysis. A review of Dvorak’s criminal history reveals a prior felony DWI conviction which can be found in Scott County file 70-CR-18-8205. A review of Dvorak’s driving record reveals that he has a no use of alcohol/drugs restriction on his license.
