On or about November 6, 2025, at approximately 12:54 A.M., a Minnesota State Trooper was on patrol in the area of I‐94 and 26th Avenue, in the City of Minneapolis, County of Hennepin, State of Minnesota. While on patrol, the trooper’s attention was drawn to a Ford (MN Plate: EHL 681) that was traveling in the left lane and continuously weaved out of its lane and onto the left shoulder. The trooper initiated a traffic stop of the vehicle. The trooper approached on the driver’s side of the vehicle and observed a male in the driver’s seat.
The trooper spoke to the male, identified by his Minnesota ID Card as Joffre Alberto Remache Marquez [DOB REDACTED], Defendant herein. The trooper noticed that Defendant did not appear to understand him when he informed the reason for the stop, and asked Defendant in Spanish. Defendant was slow to provide his identification and insurance, and stared blankly at his phone. The trooper noticed that Defendant’s eyes appeared bloodshot and watery and began to smell the odor of consumed alcohol coming from the vehicle.
Defendant was asked to step out of the vehicle. Once outside the vehicle, the trooper asked Defendant how much he had to drink. The trooper understood Defendant’s answer to be eight or eleven beers. The trooper administered the horizontal gaze nystagmus test, where the trooper observed clues of impairment. No other tests were administered. Defendant provided a breath sample for the preliminary breath test (PBT), which showed an alcohol concentration of 0.175. Defendant was placed under arrest for DWI. Defendant was transported to Hennepin County Jail.
The trooper read the Motor Vehicle Breath Test Advisory to Defendant using the language line. Defendant was provided attorney time, and Defendant agreed to take the breath test. At 2:22 A.M., Defendant provided a breath test that revealed an alcohol concentration of 0.17.
