Complainant is Minnesota State Patrol Trooper Michael Stillings. Complainant states that on March 19, 2023, at approximately 5:46pm, troopers responded to a motor vehicle accident in the city of Maple Grove, Hennepin County, Minnesota. Dispatch advised that a vehicle had crashed into a Chevron sign and was in the snowbank. Upon arrival, troopers made contact with the Maple Grove Police Department officers who arrived on scene first. Officers handed troopers the MN DL of ALEXIS JENA ANDERSON [DOB REDACTED], who was the driver and registered owner of the vehicle.
Troopers then made contact with ANDERSON and immediately detected a strong odor of alcohol coming from her person. Troopers observed ANDERSON was missing a shoe, she had watery, bloodshot eyes, and was having trouble balancing when speaking with troopers. ANDERSON advised she was coming from the Lookout Bar. ANDERSON was slurring and stumbling while she was speaking. ANDERSON admitted to drinking and stated she had half a captain and coke and a Mich-Golden beer. ANDERSON as asked to participate in Standardized Field Sobriety Tests (SFSTs) and agreed.
During HGN, troopers observed lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and onset of nystagmus prior to 45 degress in both eyes. During the one leg stand, ANDERSON began taking steps forward and had to be re-instructed of the test. On the second attempt, ANDERSON swayed and used her arms for balance, and had to put her foot down to keep from losing balance. Troopers also observed that ANDERSON seemed not to comprehend the instructions and she had to catch herself multiple times to keep from falling.
During the walk and turn, ANDERSON lost balance during the instructional phase, started before the instructions were finished, did not touch heel to toe, stepped off the line, used her arms for balance, and took an incorrect number of steps and began to walk backwards after she got to the end of the first nine steps. ANDERSON then provided a PBT sample of.236 BAC. ANDERSON was placed under arrest and transported to the West Metro State Patrol District Office where she was read a Breath Test Advisory.
ANDERSON provided a DMT sample of.20 BAC at 7:45pm, within two hours of her driving conduct. ANDERSON agreed to give a post-Miranda interview and stated that she was driving from Max's on Main and had her last drink around 6pm. ANDERSON stated she did not remember crashing, and did not remember how she got her vehicle stuck in a snowbank. ANDERSON stated she only remembers a little bit of SFSTs.
