Your Complainant is an Officer with the Owatonna Police Department. Investigation has revealed that on February 9th, 2026, at approximately 12:40AM. Officer Jimenez was patrolling the City of Owatonna, County of Steele in a fully marked squad vehicle. As Officer Jimenez was traveling Southbound on Cedar Avenue South, he observed headlights to the East of his location. The headlights were a block East of Officer Jimenez's location on School Street East. Officer Jimenez continued to patrol the area and drove by where the vehicle he had observed had it's headlights on.
The vehicle was parked facing West on School Street East and Elm Avenue South. Officer Jimenez observed a lone occupant sitting in the vehicle looking down on his lap. Officer Jimenez continued to patrol the area and eventually made contact with the vehicle. Officer Jimenez placed his squad vehicle behind the vehicle (Officer Jimenez was facing Westbound) and proceeded to make contact with the driver. It should be noted, Officer Jimenez's vehicle emergency lights were not activated. Officer Jimenez observed the vehicle to be running, and he could hear music emitting from within the vehicle.
The vehicle in question was a 2006 black Honda Civic bearing MN LIC/RGX036. Officer Jimenez walked towards the vehicle and knocked at the driver's side window, the vehicle was occupied by a lone person. As Officer Jimenez checked on the male, he observed the male to react slowly. As Officer Jimenez looked inside the vehicle and observed an open glass bottle (Officer Jimenez recognized the bottle to be a beer) sitting on the passenger side floor. Officer Jimenez observed the male to have watery eyes, slurred speech, and the odor of an alcoholic beverage was emitting from within the vehicle.
The male was identified as Darrell Jay McGuire [DOB REDACTED]. Officer Jimenez informed McGuire of the reason for the contact. McGuire stated he was in his vehicle smoking a cigarette. Officer Jimenez also told McGuire he could see an open bottle in the vehicle. Officer Jimenez asked McGuire if he had been drinking in his vehicle, he stated he had not. Officer Jimenez asked McGuire to step out of his vehicle in order to perform some tests. As McGuire stepped out of the vehicle, Officer Jimenez observed McGuire was slow, and said "I'm sorry man, I messed up." Officer Jimenez obtained the following statement from McGuire.
McGuire stated, "I went down to the bar (Officer Jimenez asked when was the last time he had a drink). I wasn't watching the Superbowl game. I drank about three (implying three drinks). I drank three big ones." During the Horizontal Gaze Nystagmus test Officer Jimenez observed the following: McGuire moved his head to follow Officer Jimenez's finger (Officer Jimenez had to tell McGuire to keep his head still), lack of smooth pursuit was observed in both eyes, distinct and sustained jerking in both eyes was observed, and distinct jerking was observed at angle of onset.
