Complainant, an investigator with the Wayzata Police Department, after reviewing all of the files in this matter, believes the following to be true: On November 4, 2025, at approximately 8:00 A.M., Police Officer O. Wallace of the Wayzata Police Department was dispatched to an incident at a school bus stop at [ADDRESS REDACTED] in the City of Wayzata, County of Hennepin. Officer Wallace spoke to the reporting party, LMM, who stated that he had been walking his son toward a stopped school bus. The school bus, which was southbound on Central Avenue, was stopped with the bus arm activated.
Central Avenue at that point is two lanes of southbound traffic and two lanes of northbound traffic and all southbound traffic had stopped for the school bus. As they were approaching the bus the driver of vehicle bearing MN license plate [PLATE REDACTED], who was northbound in the far-right lane began yelling and swearing at LMM and his son. The driver also honked his horn multiple times. The driver then made a U-turn in front of the bus, crossing all lanes of traffic on Central Avenue and began heading southbound.
The vehicle then made another U-turn on the bridge over Highway 12 and began heading northbound again. LMM described the driver as a white male with a red beard. A registration check of the vehicle came back to Nickolas James Biever [DOB REDACTED], hereinafter the “Defendant,” A DVM photo of the Defendant showed a white male with a red beard. Officer Wallace subsequently interviewed the bus driver. Her description of the driving conduct matched the conduct described by LMM. She also told Officer Wallace that the driver “flipped her off” as he went by the bus a second time.
