That on or about November 1, 2025, at approximatley 1:24 A.M., Lt. Fritz of the Minnesota State Patrol was on routine patrol, southbound on Highway 252. Lt. Fritz's attention was drawn to a Mercedes S-Class bearing Minnesota license number ZPZ-855, which was northbound on Highway 252 and traveling at a visually-high speed. Using his squad speed detection device, Lt. Fritz determined the suspect vehicle was going 96 miles/hour, well above the posted speed limit. Lt. Fritz turned his squad around and give chase, finally catching up with the suspect vehicle near Highway 610 in the city of Brooklyn Park, Hennepin County.
Lt. Fritz made contact with the driver of the suspect vehicle, identified as FLAVIO CESAR MORALES DIAZ, Defendant herein. Lt. Fritz detected the odor of consumed alcohol coming from Defendant and noted Defendant's speech was slurred. Defendant admitted consuming alcohol prior to driving. Defendant participated in field sobriety tests, revealing several clues of impairment. A PBT was administered, registering Defendant's alcohol concentration to be.12. Defendant was placed under arrest and read the Motor Vehicle Implied Consent Advisory.
Defendant did provide a consensual breath sample at approximately 2:48 A.M., revealing his alcohol concentration to be.11. Defendant has a prior alcohol- related [DL# REDACTED] from April 13, 2018.
