On or about December 1, 2025, at approximately 4:44 A.M., Officers with the Rochester police Department were dispatched to a report of vehicle with a slumped or sleeping driver parked in the 4100 block of Glouster Ln. NW, in Rochester, Olmsted County, Minnesota. Upon arrival, officers located the vehicle and observed it to be running. There was one male occupant in the driver’s seat. While looking in the vehicle, officers observed tinfoil and a grey straw on the center console. Officers knocked on the window to wake the driver.
The driver woke up and immediately hit the accelerator causing the engine to rev into high RPMs. Officers commanded the driver to exit the vehicle. The driver slowly complied and was identified as Corey Jay Gilbertson, [DOB REDACTED] (hereinafter “Defendant”). Upon exiting the vehicle, Officer Hook observed Defendant to have slow action, mumble, appeared lethargic, and had glossy eyes. Defendant admitted that he smoked heroin and last used before “before bed”. Defendant stated that he had been parked in the area since 7:00 P.M. Defendant stated that he is the only person to drive the vehicle besides his girlfriend.
Defendant’s driver’s license status was found to be Canceled – Inimical to Public Safety and he was paced under arrest. The vehicle was then searched. During the search, officers located a small drawstring bag on the floor of the driver’s seat. Inside the bag was a crystal-like substance suspected to be methamphetamine. The substance later field tested positive for methamphetamine and weighed 28.2 grams. Also in the drawstring bag was a brown powdery substance that later field tested positive for heroin and weighed.82 grams with packaging.
Inside the center console, officers located a Crown Royal bag. Inside the bag were two digital scales with a crystal residue on them and an opened 100 count package of small plastic bags. The presence of a large amount of methamphetamine, empty baggies, and used digital scales is indicative of possess with intent to distribute/sell. Defendant was transported to the Olmsted County Adult Detention Center. A search warrant was obtained to collect a fluid sample from Defendant. Defendant was advised that failure to comply with the search warrant was a crime.
Defendant submitted to a blood draw at 8:08 A.M. The sample was then sent to the Minnesota Bureau of Criminal Apprehension for analysis. Defendant has the following qualified impaired driving incidents within the ten years immediately preceding the current offense: Revocation pursuant to search warrant 171.177 (blood or urine) on 07/19/2025 – prior qualified 3 impaired loss of license. Revocation pursuant to search warrant 171.177 (blood or urine) on 06/27/2025 – prior qualified impaired loss of license.
