On or about November 3, 2025, at approximately 7:04 P.M., Sgt. Nagel was responding to a call in Hutchinson, MN, and witnessed a vehicle turn onto School Rd. From Arizona St. At a high rate of speed nearly losing control. Officer Nagel attempted to catch the vehicle on School Rd., ultimately activating emergency lights. The vehicle did not stop at School Rd and Highway 7 for a red light, and Sgt. Nagel was able to relay the plate of the vehicle (TX/ JVD4994) to dispatch. While behind the vehicle on School RD and Highway 7, Sgt.
Nagel did turn off his emergency lights in an effort to find a more suitable location so a traffic stop could be conducted. Once the light turned green the vehicle turned left/east on Highway 7. Sgt. Nagel reactivated his emergency lights. And a short time later his siren as the vehicle's speed escalated and began to pull away. Sgt. Nagel notified dispatch of his status and that he was traveling approximately 70 mph. The vehicle continued east, increasing the distance between Sgt. Nagel. It continued through Highway 7 and 15 and later Highway 7 and Bluff St. Intersections, but came to a near complete stop at Highway 7 and Michigan St. The driver, later identified as JOSHUA RYAN GRACIA, [DOB REDACTED], "Defendant" hereinafter, exited the vehicle.
Defendant would not comply with commands. Defendant was handcuffed. Officers noticed a strong smell of alcohol coming from Defendant's person, as well as poor balance and bloodshot, watery eyes. A search warrant was applied for blood or urine due to Defendant's uncooperative behavior. Defendant would be calm one moment, then become agitated and verbally combative in another. The search warrant was granted. Defendant eventually gave a sample for blood at 10:55 P.M.
