Deputy Antigua also recognized the driver as JAMES WESLEY RANDOLPH, [DOB REDACTED] [hereinafter defendant] from previous law enforcement contact. Deputy Antigua then confirmed that the defendant had a revoked driving status. Deputy Antigua attempted to follow the vehicle but was unsuccessful due to high traffic volume. Approximately 30 minutes later, Deputy Antigua observed the same vehicle with the defendant as the driver traveling northbound on 152nd Street, Sherburne County, MN and conducted a traffic stop.
Upon making contact with the defendant, the defendant admitted that he knew he should not have been driving. Deputy Antigua then observed in plain sight a small plastic baggy containing a white powdery substance located on the floorboard next to the defendant’s foot. The substance was NIK tested and rendered positive for cocaine, weighing approximately.93 grams. The Defendant was advised of his Miranda rights and admitted to Deputy Antigua that he is a cocaine user and that the substance was more than likely cocaine.
Defendant admitted that he last used four days prior. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
