On January 3, 2026, at approximately 1:21 A.M., Trooper Allen of the Minnesota State Patrol observed a vehicle almost turn the wrong direction down a one-way street. Trooper Allen followed the vehicle and observed the vehicle cross two lanes of traffic without a signal, speed, and almost collide with a center median. Trooper Allen initiated a traffic stop by turning on his emergency lights near the intersection of 14th Avenue South and Division Street in the City of St. Cloud, County of Stearns, State of Minnesota.
The driver subsequently turned down Second Street South. Trooper Allen's lights remained activated and he "chirped" his siren. The driver continued making multiple turns, albeit slowly, and failed to stop. The driver eventually turned west bound in the east bound lane of Division Street. Trooper Allen fully activated his sirens at this time and took an alternate route to try to stop the vehicle. The driver turned yet again and Trooper Allen continued to pursue. Eventually, the driver of the vehicle made a left turn and drove into a snowbank.
The driver was trying to get out of the snowbank when Trooper Allen intentionally made contact with the vehicle and his squad car to prevent the driver from leaving. The driver was identified as Richard Leroy Evensen, [DOB REDACTED], the defendant herein. Defendant was stumbling and struggling to stand up. His words were slurred, his fine motor skills were slow, and he smelled of alcohol. He provided a PBT sample which showed a 0.17 BAC. Based on all of the indicators of impairment, Trooper Allen placed the defendant under arrest for driving while under the influence of alcohol and fleeing a peace officer.
After being read the Minnesota Breath Test advisory, the defendant submitted to a Data Master breath test at 3:10 a.m, which showed an alcohol concentration level of 0.17. The observation period did have to be restarted on one occasion due to the defendant vomiting. Your complainant has reason to believe and does believe that all of the above information is true and correct. The above facts constitute your complainant's basis for believing that the above-named defendant, on or about the 3rd day of January, 2026, in the City of St. Cloud, County of Stearns, State of Minnesota, committed the offenses described herein.
