Deputy Antigua also noted that he was aware the driver, later identified as BRITTANY JEAN CRAPSER, [DOB REDACTED] [hereinafter defendant] had an active warrant for her arrest and a revoked license, which was also confirmed through NCIC. The vehicle the defendant was driving had a cracked windshield, which was obstructing the driver’s view. Deputy Antigua pulled out behind the defendant’s vehicle and initiated a traffic stop in the Coborn’s parking lot. Upon making contact with the defendant, Deputy Antigua observed in plain sight a blue plastic container with multiple pieces of burnt tinfoil.
Deputy Antigua also observed the defendant’s eyelids to be constricted and droopy. Deputy Antigua advised the defendant to step out of the vehicle as she had an active warrant. The defendant was then escorted to the patrol car. Corborn’s Staff requested the defendant’s vehicle be towed due to it blocking the pumps. Deputy Antigua requested a tow to the scene. Deputy Antigua then observed in plain sight behind the center console a partially zipped black sparkly bag with tin foil and several syringes.
Deputy Antigua retrieved the bag and located several items of drug paraphernalia inside, a clear plastic bag with a white powdery residue, naloxone vials, and a small white rubber container. Inside the container Deputy Antigua located a small amount of a white powdery substance. Deputy Antigua asked the defendant what the substance was and the defendant admitted that it was Fentanyl. Defendant also admitted that she was aware she did not have a valid license and that she had recently used controlled substances approximately two hours prior to driving.
The substance was NIK tested and rendered positive for Fentanyl weighing approximately.1 gram. PLEASE TAKE NOTICE: Pursuant to Minn.
