On April 13, 2026, at approximately 2:51 P.M., police were dispatched to Maryland Tobacco, [ADDRESS REDACTED], St. Paul, Ramsey County, Minnesota. The caller reported that for the past hour, five males were in front of the store selling marijuana. The caller stated that the males are flagging down vehicles, and he observed them make an exchange. Prior to responding, police reviewed CCTV cameras in the area. An officer observed a male, JONTAVIOUS THYRELL RUSHING – [DOB REDACTED], who the officer knew was trespassed from the property on September 27, 2025, in the parking lot.
The officer observed RUSHING and several other males walk onto the public sidewalk and begin gambling. The group placed cash on the ground then rolled dice to determine the winner. Officers coordinated an approach plan then moved in to make contact with the group. An officer approached RUSHING and began to put his hands behind his back. RUSHING looked to the side then attempted to run away from police. Following a short pursuit, RUSHING was taken into custody. Police removed a black bag from around RUSHING’s neck.
Inside the bag, police located a Smith & Wesson 9mm handgun with a loaded magazine. Police also located a small amount of marijuana and marijuana packaging from the bag. RUSHING had a bundle of cash on his person. Following a Miranda advisory, RUSHING said that he found the firearm that was recovered from his bag on the ground near Born’s Bar approximately a week earlier. RUSHING explained that he was shot in his left arm on the Fourth of July last year and carries firearms to protect himself. Upon further inspection, police discovered that the firearm was reported stolen out of Minneapolis in 2025. RUSHING is ineligible to possess firearms and ammunition due to a juvenile adjudication for First Degree Assault in Hennepin County District Court File No. 27-JV-23-1341 on July 14, 2023. The following information is offered for purposes of Rule 6.02. RUSHING has a pending felony case involving charges of Possession of a Firearm by an Ineligible Person and Possession of Ammunition by an Ineligible Person in Ramsey County District Court File No. 62-CR- 25-8940. RUSHING is out of custody on a $30,000 bond.
