11/13/1990, (35) violated the law as set forth herein. On March 31, 2026, at approximately 1:03 AM, Douglas County Sheriff’s Deputy Isaac Peterson was on routine patrol when he observed a vehicle fail to stop for a stop sign until it was nearly all the way into the intersection in the city of Brandon, Douglas County, Minnesota. Deputy Peterson conducted a traffic stop and identified the driver as Kyle Timothy Nack [DOB REDACTED], the “Defendant” herein. Upon speaking with the Defendant, Deputy Peterson observed that the Defendant was very nervous, could not hold still, had visible beads of sweat on his forehead, watery eyes and dilated pupils.
The Defendant admitted to being at a residence known for narcotic activity and stated that he was on the way to a house in Melby, MN which is also well-known for narcotic activity. He further admitted to consuming two beers earlier in the evening. The Defendant performed field sobriety testing. While performing the Horizontal Gaze Nystagmus (HGN) test, Deputy Peterson observed the Defendant’s eyes to be watery, and his pupils dilated but noted no nystagmus. The Defendant continuously tapped his right hand against his leg throughout the test.
During the Walk and Turn test, the Defendant used his arms for balance, stopped while walking, and stepped offline. During the One Leg Stand test, the Defendant used his arms for balance and swayed. While performing the Modified Romberg test the Defendant displayed eyelid tremors and estimated the passage of 30 seconds in 46.54 seconds. The Defendant was placed under arrest for suspicion of driving under the influence of a controlled substance. During a search of the Defendant’s vehicle Deputy Peterson found a small baggie containing a white crystalline substance that field tested positive for methamphetamine and weighed 0.7 grams with packaging.
Two methamphetamine pipes and several small baggies with residue were also located and field tested positive for methamphetamine A search warrant for the Defendant’s blood or urine was approved by the Honorable Timothy Churchwell. Deputy Peterson advised the Defendant that refusal to submit a sample was a crime to which the Defendant said he understood. The Defendant refused to provide a sample of his blood or urine. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. § 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges in addition to any arrest warrant that may otherwise be issued by the Court.
