At approximately 10:00 AM on October 31, 2025, Deputy Wehner of the Carver County Sheriff’s Office was dispatched to a suspicious activity report outside a residence on Trotter Trail in the City of Victoria, Carver County. The reporting party indicated an unknown male had been parked outside their home and appeared to be on a computer of some sort. The license plate provided by the reporting party registered to Gerald Mark Brewe [DOB REDACTED], hereinafter Defendant. Deputy Wehner responded to the area and located the vehicle parked directly in front of a sign stating “No Parking This Side of Street.” Deputy Wehner approached the vehicle on foot and identified Defendant to be the individual in the driver’s seat.
When Defendant rolled down the window Deputy Wehner noted a strong odor of cannabis and observed an ignition interlock device in Defendant’s vehicle. Defendant was visibly confused about where he was and was unaware of the time. Defendant was holding a lighter when speaking with Deputy Wehner and Deputy Wehner noted Defendant’s eyes to be bloodshot and that Defendant was speaking slowly. Defendant originally stated he had not used cannabis for several days, but later admitted to smoking it at around 6:00 AM. Defendant agreed to perform field sobriety tests.
Defendant would not keep his head still during the HGN Test and had to be reminded multiple timers to follow the stimulus only with his eyes. Defendant attempted to start the Walk and Turn Test early and had difficulty maintaining his stance during the instructional phase; Defendant ultimately terminated the test early after exhibiting 7 of 8 clues. Defendant exhibited all clues during the One-Leg Stand Test. Defendant provided a preliminary breath test that read.000. Defendant was placed under arrest and transported to the 212 Medical Center.
During an inventory search of Defendant’s vehicle Deputy Wehner located a glass pipe with what appeared to be freshly burned marijuana inside. Deputy Wehner obtained a search warrant for Defendant’s blood or urine. Defendant provided agreed to provide a blood sample, which has been sent to the Minnesota BCA for analysis. Defendant was previously convicted of a prior qualifying impaired driving related offense on November 3, 2016, in Court File ••-CR-••-••••. PLEASE TAKE NOTICE: Pursuant to Minn.
