On November 1, 2025, at approximately 11:09 PM, Officer Teschendorf of the Woodbury Department of Public Safety was dispatched to respond to a report of a large party occurring at 8072 Marsh Creek Alcove in the City of Woodbury, County of Washington, State of Minnesota. The complainant updated that there were a lot of people leaving who appeared to be intoxicated. Upon arrival the officer observed multiple vehicles parked on both sides of the street. The officer observed a vehicle parked nearby with multiple young males occupants.
The office stopped on the opposite side of the road and parked the squad vehicle, without activating emergency lights. The officer approached the parked vehicle, which was on and engine running. The officer made contact with the driver, later fully identified to be MASON STEPHEN GERRY [DOB REDACTED], "Defendant" herein. Defendant told the officer that he was at the party and he and his friend had been drinking alcohol. While speaking with Defendant, the officer observed him to have bloodshot/watery eyes and smelled a strong odor of an alcoholic beverage emitting from the vehicle.
The officer administered standardized field sobriety tests to Defendant, during which he performed poorly and multiple clues of impairment were observed. Defendant was placed under arrest and transported to the Woodbury Police Department. Defendant was read the Minnesota Implied Consent Advisory and was provided an opportunity to speak with an attorney. Defendant spoke to his mother during his attorney time. Defendant subsequently refused to submit to an evidentiary breath test. A review of Defendant's records shows no prior impaired driving related convictions.
Defendant was 17 years old at the time of the alleged offense.
