ABDI AYANO HAYATO, [DOB REDACTED], has the following prior convictions. On December 4, 2025, at 1:18 A.M., Trooper Dostal was on patrol driving on the ramp from northbound US 52 to 7th Street, Saint Paul, County of Ramsey, when he observed an Audi come to a sudden stop in the crosswalk.
The Audi remained in the crosswalk even after the traffic light turned green and another vehicle honked its horn. Trooper Dostal observed the driver was slumped over in the vehicle. Trooper Dostal activated emergency squad lights and approached the vehicle. The brake lights of the vehicle were on and the vehicle was in drive. The driver-later identified as HAYATO-was slumped over and asleep. Saint Paul Officers responded and observed tin foil inside the center console of the vehicle. Officers knocked on the door and awakened HAYATO, who opened the door.
HAYATO was removed from the vehicle. He was confused, did not believe he was asleep at a stoplight, and said he was tired. HAYATO had the moderate odor of alcohol. When asked how much he had to drink, he said, “not that much. I’m barely that drunk.” He said he had a sip or two of alcohol, Crown Royal Whisky. HAYATO said he had fallen asleep at the stoplight because he was exhausted, had just dropped off his daughter, and was on his way home in Woodbury. The Horizontal Gaze Nystagmus Test was administered to HAYATO. He had a lack of smooth pursuit in both eyes.
A PBT was administered to HAYATO, result.065 BAC. When asked about drugs, HAYATO said, “umm, probably have some, yeah.” HAYATO could not remember what type of drugs he used on this night, but said he normally uses “fetty.” He said he did not feel the effects of fentanyl. He said he had used “normal fentanyl” and smoked it off of tin foil. HAYATO was arrested for DWI and was searched. When asked if he had any needles on him, HAYATO said, “no, just my drugs on me.” A plastic bag with multiple smaller baggies was found in HAYATO’s left pants cargo pocket.
The baggies had a white, powdery, substance. The suspected fentanyl was weighed at the jail, approximate weight 30 grams. There was cash inside HAYATO’s right cargo pocket-total $2, 372.00. A Walther PPS.40 firearm, serial number AG6935 was found inside the vehicle in the driver’s door. There was a fully loaded magazine, round in the chamber. The firearm was reported stolen out of Saint Paul on 01/07/2025. BJ reported he was out of town. When he returned, he noticed his firearm was stolen from his vehicle.
