Jami Neyssen received information regarding a possible fraud involving public funds. Sgt. Neyssen learned that Der Thao, [DOB REDACTED], hereinafter referred to as the defendant applied for SNAP benefits and Medical Assistance for the defendant and her five children and reported that no other adult lived in the home. Law enforcement believed that Xee Yang, [DOB REDACTED] also lived at [ADDRESS REDACTED] NW in the city of Elk River, Sherburne County, Minnesota. Sgt. Neyssen retrieved calls for assistance from the city of Elk River dating back to November of 2017 that list Yang as a resident in the home.
Sgt. Neyssen called Yang and he confirmed that he lives at the Albany Street address and has done so consistently for approximately ten years. He reported the Albany address to his employers and lists that address on his driver’s license. Employment records for Yang obtained list his income at: 2022: $94,257.47 2023: $77,520.84 2024: $85,666.47 2025: $72,635.50 In the forms the defendant filed on September 16, 2024, August 29, 2025, and November 9, 2025, the defendant did not report Yang living in the household.
On August 20, 2025, the defendant completed a health care renewal form saying that the defendant lived in the household and needed heath care. She reported on that form that she was not employed and didn’t include any of the defendant’s earnings. Sgt. Neyssen spoke with Yang. Yang stated that he has lived consistently with the defendant for the last ten years. Sgt. Neyssen spoke with the defendant. She said that Yang didn’t live in the home and that he lived with his mom, but came over to take care of the children.
When Sgt. Neyssen said that the defendant told her that he lived in the home, the defendant said that he didn’t speak English well. On December 12, 2025, Deputy Neyssen received a fraud schedule from Sherburne County Health and Human Services. Based on the fraud schedule, the defendant received an overpayment of $13,727.00. Stat. 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
