THAO was carrying a sling bag containing tools. During a search incident to arrest, Investigators found a clear baggie containing suspected narcotics in his front left pocket. The substance is pending testing. THAO declined to be interviewed. When searching GARCIA, Investigators found a baggie containing suspected narcotics in her shorts pocket. GARCIA said the suspected narcotics fell out of XIONG'S backpack when she was getting out of the van and she picked it up. Additional suspected narcotics were found in a bag GARCIA had in her possession.
These substances are pending testing. Finally, GARCIA was carrying a bag containing several vehicle keys. Auto thieves commonly use shaved keys and generic vehicle keys in order to defeat a vehicle’s locking ignition. When Investigators checked the van’s VIN, it came back as stolen out of St. Paul on 3/14/26 and should have been displaying MN license plate LDA247. In a post-Miranda interview, GARCIA said she used to be in a relationship with XIONG. A few days earlier, she said, she told XIONG that she needed a ride to meet with her probation officer today and XIONG picked her up driving the van.
Then, at one point, XIONG stopped the vehicle and told everyone to run. After being Mirandized, XIONG said he knew the Investigators were following him, knew the van was stolen, and said he got it from “LOR.” XIONG showed an Investigator on a map where he threw the van’s keys after abandoning it. Investigators later located the keys. XIONG also said that the narcotics found in the bag that GARCIA was carrying were his and not hers. He also said the bag containing the vehicle keys was his.
