On or about November 16, 2025 at approximately 12:55am, Oak Park Heights police officers were returning from a traffic stop where they were assisting in the city of Bayport when they observed a vehicle in the southbound lane of 600 - [ADDRESS REDACTED] S Bayport, MN 55003 that seemed to be going faster than the posted 30mph limit. The officer confirmed the vehicle's speed as 38 MPH via squad radar. Officers stopped the vehicle and identified the driver as JACOB ANDREW SCHWARTZ, [DOB REDACTED], the defendant herein.
While speaking with him, officers immediately detected a strong odor of a consumed alcoholic beverage emanating from the vehicle and observed that his eyes were bloodshot and watery and he had a slur in his speech. The defendant provided a valid MN driver's license and advised me that he needed to find his insurance. When asked about his alcohol consumption that evening, the defendant stated he had consumed about "4 or 5" beers, specifically "Short" Coors Lights, which he had drank over the course of the night.
Officers asked the defendant to exit the vehicle to perform field sobriety tests, to which he complied. The defendant exhibited indicia of impairment, including distinct sustained nystagmus at maximum deviation in both eyes. The defendant was arrested for DWI and read the Minnesota Breath Test Advisory. The defendant indicated he understood the Advisory and consented to a breath test, which was administered within two hours of driving. The result of the test was.08. At the time of the offense, the defendant had one prior qualifying DWI conviction within ten years of the offense.
